5. Transfer of Data Outside the EU

Where the provision of data is required for this purpose, such provision shall be optional. It is understood that data processing for this purpose will only be possible with the data subject’s consent (Art. 6(1)(a) GDPR). The possible use of information relating to the use of products or services attributable to a corporate customer may also be carried out by the Data Controller without specific consent, unless otherwise provided by law. Consent may be revoked at any time in the ways indicated in section 8 below; failure to provide or withdrawal of consent shall not affect the execution of the Contract in any way.
Without prejudice to the exercise of the rights of deletion, objection and restriction of processing referred to in section 8 of this notice, the Data processed for the purposes referred to in this section will be stored and processed in compliance with applicable personal data protection regulations for the period strictly necessary to fulfill the purposes indicated above, up to a maximum of 24 months or for the longer period permitted by law for profiling activities referred to in letter a) of this section; otherwise, for the purposes referred to in letter b), processing will continue until consent is withdrawn by the Data Subject.
8. User Rights
Pursuant to European Regulation 679/2016 (GDPR), the Data Subject may exercise, in relation to the data processing described herein, the rights provided for in Articles 15-21, including:
- receive confirmation of the existence of Data and access its content (right of access);
- update, modify and/or correct the Data (right to rectification);
- request deletion or restriction of processing of Data processed unlawfully, including Data whose retention is unnecessary in relation to the purposes for which the Data were collected or otherwise processed (right to be forgotten and right to restriction);
- object to processing (right to object);
- withdraw consent, where given, without affecting the lawfulness of processing based on consent before its withdrawal;
- lodge a complaint with the Supervisory Authority (Italian Data Protection Authority – garanteprivacy.it) in the event of violations of personal data protection regulations;
- receive a copy in electronic format of the Data concerning them as Data Subject, where such Data have been provided in the context of a contract, and request that such Data be transmitted to another data controller (right to data portability).
